SAN FRANCISCO – A Contra Costa County corporation alleges its language and critical learner materials geared toward children with autism or developmental disabilities were unlawfully used by a Florida business.

Behavior Analysts Inc. filed a complaint on Feb. 9 in the U.S. District Court for the Northern District of California against Centralreach LLC and Gregory Paquette alleging copyright infringement, trademark infringement and other counts.

According to the complaint, the plaintiff alleges that the defendant initially approached it regarding an agreement for the use of the plaintiffs' ABLLS-R materials in 2015, but a licensing agreement was never reached. The plaintiff holds Centralreach LLC and Paquette responsible because the defendants allegedly used their website to make the plaintiff's ABLLS-R protocol available to their customers without the plaintiff's permission.

The plaintiff seeks to enjoin the defendants, destroy all infringing goods, damages, statutory damages, actual damages, all legal fees and any other relief as the court deems just. It is represented by Katherine F. Wenger of Brown, Gee & Wenger LLP in Walnut Creek.
