Man alleges city of Ceres did not property calculate overtime wages

SACRAMENTO – An employee has filed a class-action lawsuit against the city of Ceres over allegations of violating federal wage laws.

Carlos A. Quiroz filed a complaint on behalf of all others similarly situated individuals on Feb. 17 in the U.S. District Court for the Eastern District of California against the city of Ceres alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid the proper rate for overtime compensation. The plaintiff holds the city of Ceres responsible because the defendant allegedly failed to include all required forms of compensation for an employee's regular rate to calculate overtime compensation.

The plaintiff seeks unpaid overtime compensation and interest, liquidated damages, injunctive relief against the defendant, all legal fees and any other relief as the court deems just. He is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt in Sacramento.
