Pace Inc. alleged to owe contributions to labor union funds

SAN FRANCISCO – An employer is accused of failing to pay contributions to several labor union funds.

District Council 16 Northern California Health and Welfare Trust Fund, et al. filed a complaint on Feb. 15 in the U.S. District Court for the Northern District of California against Pace Inc., doing business as Pace Drywall, citing the National Labor Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions from June to December 2016. The plaintiffs hold Pace Inc. responsible because the defendant allegedly breached its bargaining agreement with the plaintiffs when they failed to make their monthly contribution on behalf of its employees.

The plaintiffs seek unpaid contributions, liquidated damages, interest, all legal fees, enjoin the defendant, and any other relief as the court deems just. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
