Texas individual files suit against Yahoo, Aabaco Small Business after data breach

SAN FRANCISCO – A Texas man who used Yahoo web hosting for his online insurance agency business has filed a class-action suit alleging the company failed to ensure his data was protected in a recent breach.

Brian Neff filed a complaint on behalf of all others similarly situated on Feb. 8 in the U.S. District Court for the Northern District of California against Yahoo! Inc. and Aabaco Small Business LLC alleging breach of contract, negligence and other counts.

According to the complaint, the plaintiff used the defendants' online services for consumers and small businesses. He alleges he received a notice in December 2016 from the defendants that a 2013 data breach affected his personally identifiable information. The plaintiff holds Yahoo! Inc. and Aabaco Small Business LLC responsible because the defendants allegedly failed to take adequate and reasonable measures to ensure data systems were protected and failed to promptly disclose the theft of the information.

The plaintiff requests a trial by jury and seeks enjoin the defendants, restitution and disgorgement, actual and compensatory damages, all legal fees, interest and any other relief as this court deems just.
