Woman files suit against Nextgen Leads over allegedly unlawful calls

SACRAMENTO – A Folsom consumer alleges her privacy was invaded by solicitation calls from a lead generating business.

Susan Hayes filed a complaint individually and on behalf of all others similarly situated on Feb. 14 in the U.S. District Court for the Eastern District of California against Nextgen Leads LLC and Does 1-10 alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she has suffered from abuse and harassment caused by defendant's frequent calls to solicit plaintiff to purchase its services. The plaintiff holds Nextgen Leads LLC and Does 1-10 responsible because the defendants allegedly continued to make calls despite plaintiff's explicit demand to stop the improper calls, and unlawfully utilized an automatic telephone dialing system and/or an artificial or pre-recorded voice.

The plaintiffs request a trial by jury and seek judgment against defendant, $500 in statutory damages and $1,500 in treble damages for every violation, and all other relief that the court deems just.
