LOS ANGELES – A Canoga Park consumer claims a nationwide mortgage provider and refinancer that she does not have a business relationship with unlawfully called her for solicitation purposes.
Jackie Winters filed a complaint on behalf of all others similarly situated on Feb. 21 in the U.S. District Court for the Central District of California against Wyndham Capital Mortgage Inc. and Does 1 through 10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in November 2015, she suffered damages from receiving several unwanted calls from the defendant in its attempt to solicit its services. The plaintiff holds Wyndham Capital Mortgage Inc. and Does 1 through 10 responsible because the defendants allegedly kept on calling the plaintiff using an automatic telephone dialing system despite her request to stop calling her. She also alleges her phone number is registered on the National Do-No-Call Registry.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, and any other relief as the court deems just. She is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman PC in Woodland Hills.
