LOS ANGELES – A textile manufacturer alleges its designs were unlawfully used in garments.

Broadway Textile Inc. filed a complaint on Feb. 23 in the U.S. District Court for the Central District of California against Teodolfo Ponciano Velasquez, individually, doing business as Jayvee, and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff is the creator and exclusive owner of the unique two-dimensional graphic artworks, titled Broadway Textile Design Collection - Oct. 4th. The plaintiff holds Velasquez, individually and doing business as Jayvee, and Does 1-10 responsible because the defendants allegedly manufactured, supplied and sold garments comprised of fabrics printed with plaintiff’s copyrighted designs without plaintiff’s knowledge or consent.

The plaintiff requests a trial by jury and seeks an order enjoining defendants from infringing plaintiff’s copyrighted works, award for all profits of defendants plus all losses of plaintiff, plus interest, statutory damages, attorneys’ fees and costs and such other legal and equitable relief.
