SAN JOSE – A Colusa County electrical wiring business is accused of failing to pay required contributions.
Sacramento Area Electrical Workers Health & Welfare Trust; Sacramento Area Electrical Workers Pension Trust, et al. filed a complaint on March 1 in the U.S. District Court for the Northern District of California, San Jose Division against Cross Electric and Dennis Damien Cross citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that the suffered damages due to unpaid and late paid contributions. The plaintiffs holds Cross Electric and Cross responsible because the defendants allegedly breached their bargaining agreement with the plaintiffs by failing to pay fringed benefit contribution on behalf of their employees.
The plaintiffs seek unpaid contribution of at least $29,620.13, liquidated damages in the amount of at least $3,701.54, interest, all legal fees and any other relief as the court deems just. They are represented by Benjamin K. Lunch and Wan Yan Ling of Neyhart, Anderson, Flynn & Grosboll in San Francisco.
