LOS ANGELES – A Los Angeles County woman alleges she is still disabled and that her disability benefits were wrongfully terminated.
Sabrina Kong filed a complaint on Feb. 28 in the U.S. District Court for the Central District of California against The Guardian Life Insurance Co. of America and Berkshire Life Insurance Co. of America alleging breach of contract.
According to the complaint, the plaintiff alleges that she became disabled in 2011 and was initially being paid disability benefits until it was terminated in February 2015. The plaintiff holds The Guardian Life Insurance Co. of America and Berkshire Life Insurance Co. of America responsible because the defendants allegedly rejected plaintiff's appeal based on their own assessment that she is no longer disabled.
The plaintiff requests a trial by jury and seeks refund of premiums, interest, compensatory damages, all legal fees and any other relief as the court deems just. She is represented by Robert F. Keehn of Law Office of Robert F. Keehn in Los Angeles.
