LOS ANGELES – A Riverside County resident formerly employed by United Parcel Service alleges her disability benefits were wrongfully terminated after 10 years.
Shelly Clark filed a complaint on March 1 in the U.S. District Court for the Central District of California against Metropolitan Life Insurance Co. and United Parcel Service Flexible Benefits Plan citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled in 2005 and was initially paid disability benefits until her claim was terminated in 2015. The plaintiff holds Metropolitan Life Insurance Co. and United Parcel Service Flexible Benefits Plan responsible because the defendants allegedly upheld their decision to terminate plaintiff's claim for disability benefits despite having sufficient evidence.
The plaintiff seeks payment of disability benefits, reinstatement, all legal fees, interest, and any other relief as this court deems just. She is represented by Glenn R. Kantor, Alan E. Kassan and Mitchell O. Hefter of Kantor & Kantor LLP in Northridge.
