LOS ANGELES – Clothing retailer Forever 21 is accused of unlawfully using a Los Angeles company's fabric design.
Design Collection Inc. filed a complaint on March 1 in the U.S. District Court for the Central District of California against Forever 21 Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business due to having its Jessa 13094 fabric design copied without their permission. The plaintiff holds Forever 21 Inc. and Does 1 through 10 responsible because the defendants allegedly sold garments featuring a design similar to the plaintiff's work.
The plaintiff requests a trial by jury and seeks enjoin the defendant, award profits, statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and David Shein of Doniger/ Burroughs in Venice.
