SAN DIEGO – A San Diego consumer claims that a brand of baby wipes are falsely advertised as natural.

Brittany Sebastian filed a complaint individually and on behalf of herself and others similarly situated on March 3 in the U.S. District Court for the Southern District of California against Kimberly-Clark Corp., Kimberly-Clark Worldwide Inc., and Kimberly-Clark Global Sales LLC alleging deceptive advertising practices and other counts.

According to the complaint, the plaintiff alleges that she was harmed and injured from purchasing Huggies Natural Care Baby Wipes that were advertised as being “natural,” “gentle,” “hypoallergenic,” and made with the “simplest formula for a gentle clean." The suit states the product contains non-natural, synthetic chemical ingredients, including phenoxyethanol, that can depress the central nervous system and may cause vomiting and diarrhea in infants.

The plaintiffs hold Kimberly-Clark Corp., Kimberly-Clark Worldwide Inc., and Kimberly-Clark Global Sales LLC responsible because the defendants allegedly made false and deceptive claims.

The plaintiffs request a trial by jury and seek judgment against defendants, order certifying class action, compensatory and monetary damages, restitution or disgorgement, corrective action, attorneys’ fees and costs, punitive damages, interest, and further relief as the court deems just. She is represented by Naomi Spector and Christopher D. Moon of Kamberlaw LLP in La Jolla.
