Law money 04

SAN DIEGO – A former employee of a Rancho Bernardo facility has filed a class-action suit over alleged labor law violations.

Miguel Rodriguez filed a complaint as an individual and on behalf of all others similarly situated on March 7 in the U.S. District Court for the Southern District of California against Jerome's Furniture Warehouse and Does 1-10 citing the Fair Labor Standards Act and state labor codes.

According to the complaint, the plaintiff alleges that he and other similarly situated employees and former employees have suffered damages as a result of defendants' unlawful practice of not paying overtime wages at a correct rate, not providing meal and rest period premiums, and not paying all final wages upon separation of employment. The suit states the plaintiff was employed by the defendant from July 2005 to June 2016.

The plaintiff requests a trial by jury and seek judgment against defendants; certify proposed classes; designate class representative and counsel; compensatory, consequential, general and special damages; statutory penalties; restitution; all due and unpaid wages; attorneys’ fees; costs; and further relief the court may deem just. He is represented by Paul K. Haines, Tuvia Korobkin, Fletcher W. Schmidt and Andrew J. Rowbotham of Hanes Law Group in El Segundo.
