Freeway Insurance Services Inc. alleged to have unlawfully used autodialer to contact consumer

FRESNO – A Merced consumer claims a Huntington Beach debt collector called her at a harassing rate.

Herminia Perez filed a complaint on March 8 in the U.S. District Court for the Eastern District of California, Fresno Division against Freeway Insurance Services Inc. citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls from the defendant. The suit states she asked the defendant to stop calling in September 2016. The plaintiff holds Freeway Insurance Services Inc. responsible because the defendant allegedly intentionally continued to call the plaintiff in an excessive and harassing manner using an automatic dialing system.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages, actual damages, statutory damages of $1,000, punitive damages, all legal fees, and any other relief as this court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
