Cool Breeze Refrigeration Inc. alleged to owe contributions to labor union funds

SAN FRANCISCO – An employer that conducts business in San Mateo County in construction is alleged to have failed to pay contributions on behalf of its employees.

U.A. Local No. 467 Pension Trust Fund; U.A. Local No. 467 Health and Welfare Trust Fund, et al. filed a complaint on March 10 in the U.S. District Court for the Northern District of California against Cool Breeze Refrigeration Inc. citing the Labor Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions in 2015. The plaintiffs hold Cool Breeze Refrigeration Inc. responsible because the defendant allegedly breached its bargaining agreement with the labor group by failing to make monthly contributions on behalf of its employees.

The plaintiffs seek produce and submit all missing monthly transmittals to the plaintiff, unpaid principal amounts owing, liquidated damages, interest, all legal fees and any other relief as this court deems just.
