Photographer claims Delaware North Cos. used photo in restaurant without permission

SAN FRANCISCO – A Taylorsville photographer alleges a hospitality company has unlawfully used one of his photographs in a restaurant.

Carr Clifton filed a complaint on March 10 in the U.S. District Court for the Northern District of California against Delaware North Cos. Inc. alleging copyright infringement.

According to the complaint, the plaintiff alleges that he discovered the defendant used one of his photographs will visiting the Twisted Root Burger Co. restaurant in the Dallas Fort Worth airport. The plaintiff holds Delaware North Cos. Inc. responsible because the defendant allegedly displayed plaintiff's photograph publicly without permission.

The plaintiff requests a trial by jury and seeks injunction against the defendant, impound all copies of plaintiff's photographs, actual damages, all profits, statutory damages, all legal fees, interest, and any other relief as the court deems just. He is represented by Christopher Seidman of Harmon Seidman Bruss & Kerr LLC in Grand Junction, Colorado; and by Alex Rice Kerr and Amanda L. Bruss of the same firm in Jackson, Wyoming and Denver.
