LOS ANGELES – The maker of the Banzai brand of toys and sports entertainment equipment allege two of its pool toys were copied without its consent.
Aquawood LLC filed a complaint on March 6 in the U.S. District Court for the Central District of California, Western Division against Direct Connect Marketing Inc., Alfred Fortier and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its Banzai Dive N’ Fish and the Banzai Feeding Frenzy Octopus Game copied and sold to consumers. The plaintiff holds Direct connect Marketing, Inc. Fortier and Does 1-10 responsible because the defendants allegedly duplicated plaintiff's Dive N’ Fish and the Feeding Frenzy Octopus Game.
The plaintiff requests a trial by jury and seeks compensatory damages; profits; disgorgement; order the defendant to return all originals, copies, facsimiles or duplicates which contain representations of the Dive N' Fish and the Feeding Frenzy Octopus Game; all legal fees; interest; and any other relief as this court deems just.
