Unicolors Inc. claims Gogo Apparel, others unlawfully used textile design

LOS ANGELES – A Vernon company claims one of its fabric designs was used in clothing without its permission.

Unicolors Inc. filed a complaint on March 9 in the U.S. District Court for the Central District of California against Gogo Apparel Inc., doing business as Indulge; Himansu Vermani; Minneapolis Rag Stock Co.; and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that its two-dimensional artwork GD201, or Flower 2009, was used without obtaining any form of authorization or license from plaintiff. The plaintiff holds Gogo Apparel Inc., doing business as Indulge; Himansu Vermani; Minneapolis Rag Stock Co.; and Does 1-10 responsible because the defendants allegedly manufactured or sold garments with the plaintiff's design.

The plaintiff requests a trial by jury and seeks judgment against defendants, all profits of defendants, attorneys’ fees, interest, costs of litigation, special and general damages, and further relief as the court deems proper.
