SANTA ANA – An online skin care retailer alleges competitors engaged in a campaign of false advertising against it.
Skinsolutions.MD LLC, Truventure Inc., Vishal Verma M.D. Inc. and Vishal Verma M.D. filed a complaint on March 13 in the U.S. District Court for the Central District of California, Southern Division against Global Boost MD LLC; Pharmamedrx LLC; Telladermmd LLC; Gail Gentile; Andrew McColloch, also known as Andrew McColoch; and Alexei Joukov alleging false advertising and unfair competition, trademark infringement and other counts.
According to the complaint, the plaintiffs allege that they are an authorized seller of the Latisse by prescription and that the defendants were also authorized resellers until August 2016. The plaintiffs holds Global Boost MD LLC; Pharmamedrx LLC; Telladermmd LLC; Gentile; Andrew McColloch, also known as Andrew McColoch; and Joukov responsible because the defendants allegedly made frivolous complaints to medical boards in order to damage plaintiff's reputation while using plaintiff's SkinSolutions.MD mark.
The plaintiffs request a trial by jury and seek compensatory damages, treble damages, statutory damages, restitution and disgorgement of the defendants' profits, interest, all legal fees and any other relief as the court deems just.
