Beachbody LLC claims counterfeit goods are being sold on eBay

LOS ANGELES – A Santa Monica health, wellness and fitness company claims that counterfeit versions of its DVDs and exercise kits are being sold online.

Beachbody LLC filed a complaint on March 15 in the U.S. District Court for the Central District of California, Western Division against JJ & KK Inc., Jiajia Fan, Shasha Fan and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation. The plaintiff holds JJ & KK Inc., Jiajia Fan, Shasha Fan and Does 1-10 responsible because the defendants allegedly sells counterfeit exercise kits using their accounts on eBay.com.

The plaintiff requests a trial by jury and seeks award profits and damages to the plaintiff, actual damages, statutory damages, injunction against the defendants, disgorgement, restitution, order the destruction of all infringing products, damages, exemplary or punitive damages, all legal fees, and any other relief as this court deems just.
