LOS ANGELES – An Orange County business is alleged to have not paid contributions to several labor union funds.
Board
of Trustees of the Cement Masons Southern California Health and Welfare
Fund, et al. filed a complaint on March 15 in the U.S. District Court
for the Central District of California against Klassic Engineering and
Construction Inc. alleging breach of contract and violation of the
Employee Retirement Income Security Act.
According to the
complaint, the plaintiffs allege that they suffered damages due to
unpaid and late paid contributions from periods in 2013 and 2014. The
plaintiffs hold Klassic Engineering and Construction, Inc. responsible
because the defendant allegedly breached its bargaining agreement with
the plaintiff by failing to make contributions on behalf of its
employees.
The plaintiffs seek unpaid contributions and damages
plus audit contributions in the amount of $5,913.58, plus any additional
unpaid contributions, interest of 7 percent, liquidated damages at the
rate of 10 percent, all legal fees and any other relief as the court
deems just. They are represented by Kathryn J. Halford, Elizabeth
Rosenfeld and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford
& Rosenfeld in Encino.
