LOS ANGELES – A Newport Beach corporation specializing in electric passenger boats and leisure water craft under the Duffy mark alleges a Newport Harbor business is using the mark without authorization.
Duffield Marine Inc. filed a complaint on March 13 in the U.S. District Court for the Central District of California against Duffy Boat Rentals Long Beach, also known as Anchors Away Boat Rentals, and Does 1-50 alleging trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Duffy Boat Rentals Long Beach, also known as Anchors Away Boat Rentals, and Does 1-50 responsible because the defendants allegedly used the Duffy mark to promote their business with the intent to cause confusion among plaintiff's consumers.
The plaintiff requests a trial by jury and seeks enjoin the defendants, pay the plaintiff for damages and profits, treble damages, all legal fees and any other relief as the court deems just. It is represented by William R. Hart and David Christopher Baker of Hart King Professional Corp. in Santa Ana.
