Redwood Cafe alleged to have unlawfully performed songs

SAN FRANCISCO – A Modesto cafe is accused of performing music by Paul Simon and Stevie Nicks without a license.

Broadcast Music Inc., Paul Simon Music, Welsh Witch Music and Sony/ATV Songs LLC filed a complaint on March 21 in the U.S. District Court for the Eastern District of California against Vintage Enterprises LLC, doing business as Redwood Cafe, and Robert Campana alleging copyright infringement.

According to the complaint, the plaintiffs allege that they suffered damages from having their musical compositions being performed without their consent. The suit states these songs included "The Boxer," written by Simon, and "Dreams," written by Nicks. The plaintiffs holds Vintage Enterprises LLC and Campana responsible because the defendants allegedly continued to use plaintiffs' musical compositions despite being notified by the plaintiffs more than 40 times regarding their obligations under the Copyright Act.

The plaintiffs seek to enjoin the defendants, order the defendants to pay statutory damages, all legal fees and any other relief as the court deems just. They are represented by Karen S. Frank and Thomas A. Harvey of Coblentz Patch Duffy & Bass LLP in San Francisco.
