Man alleges benefits were wrongfully terminated by AT&T West Disability Benefits Program

SAN FRANCISCO – A man alleges he appealed the termination of his disability benefits and that he never received a response.

Vanmark Strickland filed a complaint on March 15 in the U.S. District Court for the Northern District of California against AT&T West Disability Benefits Program alleging violation of the Employee Retirement Income Security Act and breach of contract.

According to the complaint, the plaintiff alleges that he became disabled in 2013 and applied for disability benefits and was approved. The suit states the defendant denied benefits effective May 2016 over claim it had not received updated medical information. The plaintiff holds AT&T West Disability Benefits Program responsible because the defendant allegedly appealed the decision and provided the missing records, but did not respond to the submission.

The plaintiff seeks benefits due plus interest at 10 percent per annum; benefits at the rate of $1,205 per month plus interest at 10 percent per annum; general damages in the amount of $250,000; punitive or exemplary damages in the sum of $250,000; all legal fees in the amount of $200,000; and any other relief as this court deems just.
