Fastaff LLC, U.S. Nursing Corp. alleged to have not properly calculated overtime rate

SAN FRANCISCO – A staffing company for health care professionals is accused of unlawfully withholding wages.

Stephanie Dalchau and Michael Goodwin filed a complaint on behalf of all other similarly situated on March 24 in the U.S. District Court for the Northern District of California against Fastaff LLC, U.S. Nursing Corp. and Does 1 to 10 alleging violation of the Fair Labor Standards Act.

According to the complaint, Dalchau was employed at the defendants' Petaluma location in 2015 and Goodwin was employed in Indiana in 2016. The plaintiffs holds Fastaff LLC, U.S. Nursing Corp. and Does 1 to 10 responsible because the defendants allegedly failed to include the value of housing benefits when calculating overtime pay and failed to pay wages due at the end of their employment.

The plaintiffs request a trial by jury and seek unpaid wages plus interest, restitution, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Matthew B. Hayes and Kye D. Pawlenko of Hayes Pawlenko LLP in Pasadena.
