SAN FRANCISCO – A San Jose Brazilian jiu-jitsu martial arts business alleges its registered mark is being used by a company in the Philippines.
VB Partners LLC, doing business as Lute!, filed a complaint on March 27 in the U.S. District Court for the Northern District of California against Lute Lifestyle Brands and Does 1 through 10 alleging service mark infringement, false designation of origin and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Lute Lifestyle Brands and Does 1 through 10 responsible because the defendants allegedly used the Lute mark for apparel and for sponsoring events worldwide without authorization.
The plaintiff requests a trial by jury and seeks enjoin the defendant, deliver for destruction all infringing materials, all profits, damages, award three times damages to the plaintiff, punitive damages, all legal fees, interest, and any other relief as the court deems just.
