Former nurse seeks payment of disability benefits from Prudential Insurance Co.

SAN JOSE – A former dialysis nurse alleges his long-term disability benefits were wrongfully terminated.

Brian Williams filed a complaint on March 27 in the U.S. District Court for the Northern District of California, San Jose Division against The Prudential Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that the defendant previously paid 24 months of disability benefits until the benefits were terminated in 2014. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly violated the terms of the plan by denying the plaintiff's benefits.

The plaintiff seeks order the defendant to pay long-term disability benefits to the plaintiff plus interest, all legal fees and any other relief as the court deems just. He is represented by Michelle Roberts Bartolic of Robert Bartolic LLP in Alameda.
