Man files suit against ICE, Customs and Border Protection alleging false imprisonment

SAN DIEGO – A man alleges he was held at a detention facility for several months without good cause or legal authority.

Jemy Attallah filed a complaint on March 20 in the U.S. District Court for the Southern District of California against United States of America acting through its agency Customs and Border Protection; Doe Officer 1 through 20; Immigration and Customs Enforcement; Doe Agents 1 to 20; and Corrections Corp. of America Inc. alleging false imprisonment and other counts.

According to the complaint, the plaintiff alleges that in 2013, he entered the U.S. through Mexico with a waiver visa. He alleges he was detained by the defendants on Sept. 19, 2013, and taken to the East Mesa Detention Facility in San Diego where he was held to June 10, 2014. The suit states he was granted asylum from Egypt on June 9, 2014. He alleges that while he was detained, his laptop was damaged while in property holding.

The plaintiff requests a trial by jury and seeks general damages, special damages, medical expenses, damages of property, interest, all legal fees, punitive damages, and any other relief as the court deems just.
