Wells Fargo Bank alleged to have kept calling consumer after she requested calls to stop

SAN DIEGO – A San Diego woman claims a debt collector unlawfully called her using an automatic dialer.

Jodi Rothery filed a complaint on March 22 in the U.S. District Court for the Southern District of California against Wells Fargo Bank NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Feb. 10 she suffered damages from receiving several collection calls from the defendant. The plaintiff holds Wells Fargo Bank NA responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling her and used an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages, actual damages, statutory damages of $1,000, all legal fees, punitive damages and any other relief as the court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
