Apogee Peptides accused by Nutrition Distribution of false advertising

SAN DIEGO – An Arizona nutritional supplement company alleges a Florida competitor misleads consumers with the advertising of some of its products.

Nutrition Distribution LLC filed a complaint on March 23 in the U.S. District Court for the Southern District of California against Apogee Peptides LLC and Does 1 through 10 alleging false advertising.

According to the complaint, the plaintiff alleges that the defendants engage in false and misleading advertising regarding their "research chemicals." The plaintiff holds Apogee Peptides LLC and Does 1 through 10 responsible because the defendants allegedly sell the chemicals as not for human consumption and "for laboratory research only," but markets them for personal use.

The plaintiff requests a trial by jury and seeks enjoin the defendant, compensatory damages, profits, restitution, treble damages, punitive damages, all legal fees and any other relief as the court deem just. It is represented by Robert Tauler and Matthew J. Smith of Tauler Smith LLP in Los Angeles.
