SAN DIEGO – Two real estate agents in San Diego County claim a company unlawfully contacted them.
Jacob Tiffany and Erik Knutson filed a complaint on behalf of all others similarly situated on March 24 in the U.S. District Court for the Southern District of California against Roar Construction Inc. alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiffs allege that in 2017, they suffered damages from receiving several unwanted calls from the defendant stating it is looking to partner with real estate agents to purchase properties. The plaintiffs hold Roar Construction Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiffs without their consent.
The plaintiffs request a trial by jury and seek $500 in statutory damages, injunctive relief, treble damages of $1,500, and any other relief as the court deems just. They are represented by Joshua Swigart and Kevin Lemieux of Hyde and Swigart in San Diego.
