SAN DIEGO – A Del Mar corporation has filed suit against the owners of several department stores over allegations it sells infringing suitcases.
Nuki Inc. filed a complaint on March 29 in the U.S. District Court for the Southern District of California against Marshalls of CA LLC, Marshalls of MA Inc., The TJX Cos. Inc. and Does 1-10 alleging patent infringement.
According to the complaint, the plaintiff alleges that Nuki Inc. sells luggage and has developed a patent for a front-opening, hard-shell suitcase. The plaintiff holds Marshalls of CA LLC, Marshalls of MA Inc., The TJX Cos. Inc. and Does 1-10 responsible because the defendants allegedly sells hard shell suitcases that infringes plaintiff's patent.
The plaintiff requests a trial by jury and seeks permanent injunction, award profits to the plaintiff, all damages, treble damages, all legal fees and any other relief as the court deems just.
