SAN DIEGO — A parking meter company is suing Civicsmart Inc., Duncan Parking Technologies Inc. and Duncan Solutions Inc., citing alleged patent infringement for selling an infringing product.
IPS Group Inc., headquartered in San Diego, filed a complaint on March 29 in the U.S. District Court for the Southern District of California against the defendants alleging that they sell a product called Liberty Meter that infringes plaintiff's patent.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its patent infringed. The plaintiff holds the defendants responsible because they allegedly continued to sell and distribute their Liberty Meter despite knowing that the product was infringing plaintiff's patents.
The plaintiff requests a trial by jury and seeks to enjoin the defendant, damages, treble damages, exemplary damages, all legal fees and any other relief as the court deems just. The plaintiff is represented by Douglas Carsten and Nathaniel R. Scharn of Wilson Sonsini Goodrich & Rosati P.C. in San Diego.
