LOS ANGELES – A corporation based in Hong Kong claims that some of its cargo was damaged in a train accident in Texas.
Orient Overseas Container Line LTD filed a complaint on March 28 in the U.S. District Court for the Central District of California, Western Division against BNSF Railway Co. and Burlington Northern Santa Fe LLC alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that in June 2016 it suffered damages to its business from having its cargo damaged during transit in a train collision in Texas. The plaintiff holds BNSF Railway Co. and Burlington Northern Santa Fe LLC responsible because the defendants allegedly breached their contractual agreement with the plaintiff by failing to deliver the cargo in the same good condition when it was received.
The plaintiff seeks damages in a sum no less than $1,587,779.80, plus interest, all legal fees and any other relief as this court deems just. It is represented by Stacey H. Wang of Holland & Knight LLP in Los Angeles.
