LOS ANGELES – An individual has filed a class-action lawsuit against a printer ink cartridge business over allegations it unlawfully sent faxes to solicit its services.
Vahe Messerlian filed a complaint on behalf of all others similarly situated on March 30 in the U.S. District Court for the Central District of California against The Toner Doctor and Does 1 through 10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in March 2015, he suffered damages from receiving several unwanted faxes from the defendant. The plaintiff holds The Toner Doctor and Does 1 through 10 responsible because the defendants allegedly sent faxes without having prior consent. He alleges he has never been a customer of the defendant.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 as treble damages and any other relief as the court deems just. He is represented by Todd M. Friedman of Law Offices of Todd M. Friedman PC in Woodland Hills.
