LOS ANGELES – Soundtrack and trailer composers known as the Heavy Young Heathens allege their composition was unlawfully used in a YouTube video.
Robert J. Marderosian and Aron M. Marderosian filed a complaint on March 31 in the U.S. District Court, Western Division for the Central District of California against Daymak Inc. and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiffs composed "Cut Lip" in 2013. The plaintiffs holds Daymak Inc. and Does 1-10 responsible because the defendants allegedly published a YouTube video where it used plaintiff's composition and musical recording without authorization to advertise their Beast motorized vehicles in 2014.
The plaintiffs request a trial by jury and seek injunction against the defendants, damages, profits, statutory damages, interest, all legal fees and any other relief as the court deems just. They are represented by Brian G. Wolf and Henry L. Self III of Lavely & Singer Professional Corporation in Los Angeles.
