Minegar Contracting Inc. alleges it is owed more than $75,000 for construction work

LOS ANGELES – A San Diego subcontractor alleges it was not paid for construction work on a federal project.

United States, for the use of Minegar Contracting Inc., filed a complaint on March 27 in the U.S. District Court for the Central District of California against T.B. Penick & Sons Inc., Liberty Mutual Insurance Co. and Does 1 to 10 citing breach of contract.

According to the complaint, T.B. Penick & Sons Inc. entered into a contract with the United States for a construction project in Twentynine Palms and that Minegar was a subcontractor. The plaintiff holds T.B. Penick & Sons Inc., Liberty Mutual Insurance Co. and Does 1 to 10 responsible because the defendants allegedly breached their agreement with the plaintiff by failing to pay Minegar Contracting.

The plaintiff seeks $75,471.47, plus interest at the rate of 10 percent per annum, all legal fees and any other relief as this court deems just. They are represented by James H. Flaherty Jr. and Douglas P. Flaherty of Flaherty & Flaherty in San Diego.
