LOS ANGELES – A Brea medical and pharmaceutical management services provider alleges a Texas company is using a similar logo.
NS and Associates LLC, doing business as Pharmedquest Pharmacy Services, filed a complaint on March 28 in the U.S. District Court for the Central District of California against PatientCraft LLC, and Does 1-10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that since 1992, it has offered the P340B program and that it was granted a federal service mark registration for the brand name and Spiral P logo in December 2016. The plaintiff holds PatientCraft LLC and Does 1-10 responsible because the defendants allegedly used a similar spiral P logo to the plaintiff to advertise its Patient Craft services.
The plaintiff seeks to permanently enjoin the defendant from further infringing plaintiff's trademark; require the defendant to pay all gains, profits, and advantages to the plaintiff; order the defendant to deliver up for destruction all infringing materials; all legal fees; exemplary or enhanced damages; and any other relief as this court deems just.
