LOS ANGELES – Two California consumers have filed a class-action lawsuit against Charter Communications Inc. and Spectrum Management Holding Co. LLC alleging false and misleading advertising.
Elizabeth Hart and Le'Roy Roberson filed a complaint on behalf of all others similarly situated on March 28 in the U.S. District Court for the Central District of California against Charter Communications Inc. and Spectrum Management Holding Co. LLC citing the Lanham Act, the False Advertising Law and other counts.
According to the complaint, the plaintiffs allege that they were deceived by the defendants' statements concerning their internet services. The plaintiffs hold Charter Communications Inc. and Spectrum Management Holding Co. LLC responsible because the defendants allegedly promised to deliver fast internet speeds to their customers despite knowing that they could not deliver. The suit states that the defendants have not invested in the infrastructure and equipment necessary.
The plaintiffs request a trial by jury and seek actual, consequential, and punitive damages; restitution; disgorgement of profits; all legal fees; interest and any other relief as the court deems just.
