Whipple Taqueria accused of failing to pay overtime to former manager

SAN JOSE – A Union City joint employer is alleged to have failed to pay overtime and other violations.

Antonio Alcantara filed a complaint on March 31 in the U.S. District Court for the Northern District of California, San Jose Division against Jackson Joseph Puraympallil and Johnson Puraympallil, both individually and doing business as Whipple Taqueria citing state labor codes.

According to the complaint, the plaintiff alleges that he was employed by the defendants as a manager from November 2011 to December 2016. The plaintiff holds Jackson Joseph Puraympallil and Johnson Puraympallil, both individually and doing business as Whipple Taqueria, responsible because the defendants allegedly failed to properly record all hours that the plaintiff worked, did not provide a duty-free lunch break or rest breaks and failed to pay overtime wages.

The plaintiff requests a trial by jury and seeks compensatory damages for unpaid overtime wages in the amount of $47,708, liquidated damages in the amount of $43,958, restitution, waiting time penalty damages of 30 days' wages to plaintiff in the amount of $3,360, damages for inadequate pay statements in the amount of $4,000, damages for each missed meal and rest periods in the amount of $13,011, interest of 10 percent on the unpaid overtime compensation, all legal fees and any other relief as this court deems just.
