Consumer alleges 21st Amendment Brewery Cafe's marketing is misleading

SAN FRANCISCO – A San Leandro company is alleged to falsely advertise its beer.

Brendan Peacock filed a complaint on behalf of all others similarly situated on April 6 in the U.S. District Court for the Northern District of California against The 21st Amendment Brewery Cafe LLC alleging violation of the Unfair Competition Law.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a falsely advertised product believing that it is brewed exclusively in the Bay Area. The plaintiff holds The 21st Amendment Brewery Cafe LLC responsible because some of the product is allegedly brewed in Minnesota.

The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to conduct a corrective advertising, pay restitution, interest, disgorge all monies wrongfully obtained, damages, all legal fees and any other relief as the court deems just.
