California corporation sue New York company
LOS ANGELES — A California corporation are suing Wishbone Collection, LLC, and Does 1-10, New York company, citing alleged unfair competition.
Etel Group, Inc., Creative Intelligence Advertising, Scott Lavitt & Judie Levine filed a complaint on April 3, in the U.S. District Court for the Central District of California against the defendants alleging that they claims that the plaintiff is infringing their trade dress.
According to the complaint, the plaintiffs allege that Etel Group, Inc., Creative Intelligence Advertising, Scott Lavitt & Judie Levine suffered damages from being accused of trademark infringement. The plaintiffs holds Wishbone Collection, LLC, and Does 1-10 responsible because the defendants allegedly sent a letter to the plaintiff demanding that they terminate the use of the StickerBeans designs and packaging.
The plaintiffs request a trial by jury and seek declare that the defendant has no valid protectable proprietary rights in the trademark, declare that the plaintiff does not infringe the defendant's trademark, injunction against the defendant, all legal fees and any other relief as this court deems just. They are represented by Brandon J. Witkow and Cory A. Baskin of Witkow Baskin in Woodland Hills.
