Valfre LLC accuses Rue21 of using design on earbuds

LOS ANGELES – A fashion and design company alleges a retailer unlawfully used its design on accessories.  

Valfre LLC filed a complaint on April 3 in the U.S. District Court for the Central District of California against Rue21 Inc. and Does 1 through 10 citing copyright infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages from having its designs copied. The plaintiff holds Rue21 Inc. and Does 1 through 10 responsible because the defendants allegedly sell earbuds that infringe plaintiff's design.

The plaintiff requests a trial by jury and seeks award of all profits, statutory damages, disgorgement of profits and other damages, all damages, actual damages, interest, punitive damages, all legal fees and any other relief as the court deems just.
