Man claims McCarthy, Burgess & Wolff unlawfully contacted him

LOS ANGELES – A Ventura County man alleges a debt collector unlawfully contacted him instead of his counsel.

Christopher Phillips filed a complaint on April 4 in the U.S. District Court for the Central District of California against McCarthy, Burgess & Wolff Inc. and Does 1 to 10 citing the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2016, the defendants contacted him via phone demanding that he pay a debt that he alleges is not owed. The plaintiff holds McCarthy, Burgess & Wolff Inc. and Does 1 to 10 responsible because the defendants allegedly called the plaintiff directly to collect an alleged debt despite knowing that he is already being represented by an attorney.

The plaintiff requests a trial by jury and seeks actual damages in the sum of $100,000, statutory damages of no less than $1,000, all legal fees, and any other relief as the court deems just. He is represented by Louis P. Dell of Law Office of Louis P. Dell in Burbank.
