JCR Fabrics allege Amazon, other department stores infringed textile design

LOS ANGELES – A textile company alleges that Amazon, Kohls and others offer garments made with infringing fabric designs.

JCR Fabrics LLC filed a complaint on April 7 in the U.S. District Court for the Central District of California, Western Division against J.B.S. LTD, Fabtrends International Inc., Fabtrends USA Corp., Amazon.com LLC, Belk Inc., Burlington Stores Inc., Boscov's Department Store LLC, Drapers & Damon LLC, J.C. Penney Co. Inc., Kohls Department Stores, Ross Stores, Steinmart Inc., Target Corp. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to their business as the result of its designs being copied. The plaintiff holds J.B.S. LTD, Fabtrends International Inc., Fabtrends USA Corp., Amazon.com LLC, Belk Inc., Burlington Stores Inc., Boscov's Department Store LLC, Drapers & Damon LLC, J.C. Penney Co. Inc., Kohls   Department Stores, Ross Stores, Steinmart Inc., Target Corp. and Does 1  through 10 responsible because the defendants allegedly sold or manufactured garments made out of fabrics that bear plaintiff's designs.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, all profits, statutory damages, all legal fees, damages, destroy or impound all infringing products, interest, and any other relief as the court deems just.
