Representatives of woman killed in bus crash accuse state of negligence

SAN FRANCISCO – Estate representatives of a woman have filed suit against the state of California over allegations of wrongful death.

Estate of Fely Olivera; Antonio Olivera, individually and as successor-in-interest and personal representative for the estate of Fely Olivera; Albert Olivera; Gabriel Olivera and Joy Olivera filed a complaint on March 28 in the San Francisco County Superior Court against the state of California and Does 1 to 50 alleging negligence and wrongful death.

According to the complaint, the plaintiffs allege that Fely Olivera was traveling on a Greyhound bus on Highway 101 in January 2016 and that the bus collided with a crash attenuator at the US 101/state Route 85 interchange, killing her.

The plaintiffs hold the state of California and Does 1 through 50 responsible because the defendants were allegedly careless in the design, construction, maintenance and repair of the roadway and adjacent area. The suit states that signage was misplaced, a reflective placard was missing and road lines were difficult to see.

The plaintiffs seek noneconomic damages, economic damages, all legal fees, interest, and any other relief as the court deems just. They are represented by Richard H. Schoenberger and Matthew D. Davis of Walkup, Melodia, Kelly & Schoenberger in San Francisco.
