Consumer claims Navient Solutions kept calling her after she revoked consent

Phone 02

SACRAMENTO – A Sacramento individual alleges a debt collector used an automatic dialing system to call her at an excessive rate.

Laura Stauffer filed a complaint on April 12 in the U.S. District Court for the Eastern District of California against Navient Solutions Inc. citing the Fair Labor Standards Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls on her cellphone from the defendant. The plaintiff holds Navient Solutions Inc. responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling her and used an automatic dialing system.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages, statutory damages of $1,000, all legal fees, punitive damages and any other relief as the court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
