SAN FRANCISCO – The Group Long Term Disability Plan for employees of Foto-Kem Industries Inc. is accused of unlawfully denying disability benefits.
Dana Cicerone filed a complaint on April 12 in the U.S. District Court for the Northern District of California against Group Long Term Disability Plan for employees of Foto-Kem Industries Inc. and Foto-Kem Industries Inc. citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff suffered damages from not being paid disability benefits. The plaintiff holds Group Long Term Disability Plan for employees of Foto-Kem Industries Inc. and Foto-Kem Industries Inc. responsible because the defendants allegedly terminated plaintiff's benefits despite having no reasonable basis for the termination.
The plaintiff seeks benefits due to the plaintiff, interest, statutory penalties, all legal fees, and any other relief as the court deems just. The plaintiff is represented by Julian M. Baum of Julian M. Baum & Associates in Novato.
