LOS ANGELES – A La Mirada woman alleges she is entitled to disabilty benefits from her insurer.
Dora Martinez filed a complaint on April 14 in the U.S. District Court for the Central District of California, Western Division against The Prudential Insurance Co. of America and Does 1 to 10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2014, she became disabled and applied for disability benefits but was denied. The plaintiff holds The Prudential Insurance Co. of America and Does 1 to 10 responsible because the defendants allegedly failed to conduct a full and fair review of the plaintiff's claim.
The plaintiff requests a trial by jury and seeks all plan benefits due and owing to the plaintiff, interest, all legal fees and any other relief as the court deems just. She is represented by Robert J. McKennon and Joseph S. McMillen of McKennon Law Group PC in Newport Beach.
