Woman alleges she was not paid overtime during her employment as a caregiver

LOS ANGELES – A caregiver has filed a class-action lawsuit against her former employer over allegations that it did not provide meal or rest breaks.

Angelina Ponce, individually and on behalf of all others similarly situated filed a complaint on April 14 in the U.S. District Court for the Central District of California, Western Division against United Cerebral Palsy/Spastic Children's Foundation of Los Angeles and Ventura Counties and Does 1-10, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a nonexempt caregiver from 2002 to February 2015. She alleges she worked more than 40 hours in a workweek, was denied meal periods and rest periods.

The plaintiff alleges the defendants failed to pay overtime compensation, failed to provide meal periods, failed to authorize and permit paid rest periods and failed to timely pay all wages owed upon separation.

The plaintiff requests a trial by jury and seek seek payment for general damages, liquidated damages, interest, attorneys' fees and other further relief as the court deems proper. She is represented by James R. Hawkins and Gregory Mauro of James Hawkins APLC in Irvine.
